Product Liability

We can offer advice to business on product liability covering items from general giftware to toys. We act for some of the largest importers of giftware and toys into the United Kingdom and regularly deal with Trading Standards departments in England, Wales and Scotland. We aim to convince the Trading Standard department to withdraw their case or settle matters, so there is no need to become involved in costly court cases. However, if the matter does proceed all the way to court we will instruct Counsel to attend the hearing. We have good relations with some of top specialist barristers. We can advise you on internal safety procedures and help you to produce a comprehensive Safety Manual for your business. Our main area of expertise under the umbrella of product liability is the liability for defective products under statute, under the General Product Safety Regulations and the Toy Safety Regulations.

We have recently acted for two of the largest giftware importers and successfully defended them, when they were accused of selling defective candles. We were able to show misuse by the user and due diligence by the importer.
