For many years we have acted for one of the largest and most
prestigious importers of giftware and toys into the UK. For more
than 30 years we have helped this client with the ever changing
regulatory structure concerning these items. We have in-depth
expertise on product liability, and not only advise on the law,
but also assist in negotiations with Trading Standards often being
able to avoid a contest before the Courts.
On those occasions when Court is unavoidable, we have had a remarkably
successful run of cases which have decided important questions
regarding the extent of liability often defining what is and is
not a toy. For example, we were able to prove to the Court that
porcelain dolls (which are worth more than £15 million per
year to the giftware industry) should not be treated as toys and
therefore subject to the Toy (Safety) Regulations, but are ornaments
or giftware and covered by less rigorous safety rules.
